{"id":4816,"date":"2020-11-13T15:49:23","date_gmt":"2020-11-13T15:49:23","guid":{"rendered":"https:\/\/tothepointanalyses.com\/?p=4816"},"modified":"2020-11-16T15:27:53","modified_gmt":"2020-11-16T15:27:53","slug":"an-encore-for-charlie-hebdo","status":"publish","type":"post","link":"https:\/\/tothepointanalyses.com\/an-encore-for-charlie-hebdo\/","title":{"rendered":"An Encore for Charlie Hebdo"},"content":{"rendered":"\n<p>An Encore for <em>Charlie Hebdo<\/em>\u2014An Analysis (13 November 2020) by Lawrence Davidson<\/p>\n\n\n\n<p>Part I\u2014Insulting Islam<\/p>\n\n\n\n<p>In mid October 2020 a French schoolteacher, 47-year-old Samuel Paty, decided to show his Freedom of Speech class cartoons demeaning Islam\u2019s founding prophet, Mohammed. The cartoons were the same ones originally published by the satirical magazine <em>Charlie Hebdo<\/em> (<em>Charlie Weekly<\/em>) in 2014-2015. At that time, the magazine\u2019s actions resulted in the murder of twelve of its staff, including the editor, Stephane Charbonnier. The murders were committed by Muslim extremists associated with al-Qaeda. Samuel Paty\u2019s fate turned out to be similar. Shortly after having shown the caricatures of the founder of Islam, the teacher was murdered by an 18-year-old Muslim immigrant. Other attacks have followed. <\/p>\n\n\n\n<p>In all of these cases, the killings were provoked as well as indefensible. The cartoons in question are all too easy to interpret as gratuitous insults against Islam and therefore against the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Islam_in_France\">almost 9% of the French population<\/a> that are Muslim. Nonetheless, murder is incompatible with stable society. The latter being prima facie true, the next question is, What alternatives were available to those who were\/are disgusted by the <em>Charlie Hebdo<\/em> caricatures? <a href=\"https:\/\/en.wikipedia.org\/wiki\/Charlie_Hebdo#Amatrice_v._Charlie_Hebdo_(2016)\">Lawsuits for defamation<\/a> have been repeatedly filed. Some are still ongoing. However, to date, none have stopped the magazine\u2019s demeaning ways. Well-organized public protests combined with steady political pressure might work in the long run. It was perhaps because such an effort was not forthcoming, at least not consistently, that action defaulted to emotionally driven individual fanatics.<\/p>\n\n\n\n<p>By the way, <em>Charlie Hebdo<\/em>, with its own brand of fanaticism, is what you might call an equal opportunity defamer. Topics ranging from the Catholic Church to Italians killed in earthquakes have been depicted in distasteful, sometimes semi-pornographic fashion. As it stands, the right to publish gratuitously insulting cartoons is not only legal in France but, because of all the related violence, also now defended as an important expression of French national culture. To make this point clear, French <a href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/France-Muhammad-cartoons.html\">officials have announced the publication<\/a> of a booklet to include the <em>Charlie Hebdo<\/em> images. This will be \u201chanded out to high school students as a commitment to defend the values of the Republic.\u201d<\/p>\n\n\n\n<p>Part II\u2014A Trap <\/p>\n\n\n\n<p>The value referred to in the booklet is freedom of expression. As Charbonnier said in a 2012 interview, \u201cWe can\u2019t live in a country without freedom of speech. I prefer to die than to live like a rat.\u201d Of course, it is now obvious that Charbonnier\u2019s ardent determination to avoid a rodent\u2019s fate, and his nation\u2019s embrace of the man\u2019s grossness as a symbol of free speech, has led France into a trap. Here is how the Sorbonne Professor <a href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/France-Muhammad-cartoons.html\">Pierre-Henri Tavoillot puts it<\/a>: \u201cwhat is at stake now is France\u2019s <em>laicite<\/em>\u2014the secularism that underlies its culture. If the nation compromises on <em>laicite <\/em>in this instance, this cultural principle may well unravel.\u201d Refusal to consider a balanced way out of the situation paints the French into a corner while explicitly tying the culture to often semi-pornographic cartoons. <\/p>\n\n\n\n<p>The trap has many other dimensions. French enthusiasm for <em>Charlie Hebdo<\/em> <a href=\"https:\/\/asiatimes.com\/2020\/11\/deja-vu-in-france-change-in-attitudes-needed\/\">has fueled Islamophobia<\/a> and led others to use the situation to argue for the <a href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/France-Muhammad-cartoons.html\">restriction of civil rights<\/a>. France\u2019s interior minister believes that the country is \u201cat war against an enemy who is both inside and outside.\u201d While it is true that the country\u2019s 5.7 million Muslims (the highest number in any Western country) are increasingly alienated and fearful, the vast majority are peaceful. Yet they all have now been placed under suspicion of being terrorists. Now, the mayor of Nice is calling for a \u201cmodification of the Constitution\u201d so that the nation can \u201cproperly wage war against Islamic extremists.\u201d President Macron has announced a widespread crackdown on \u201cIslamist individuals and organizations.\u201d This includes closing French Muslim civil rights organizations and Arabic language schools. <\/p>\n\n\n\n<p>The whole affair has also brought France into conflict with Muslim populations and governments around the world. Presently, the French and Turkish governments are now trading insults. In Bangladesh, 40,000 people took part in an anti-French demonstration and called for the boycott of French goods. French goods were removed from shelves in shops in Qatar and Kuwait. <\/p>\n\n\n\n<p>Part III\u2014Rationalizations<\/p>\n\n\n\n<p>The French will tell you that their take on free expression <a href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/France-Muhammad-cartoons.html\">was born in violence<\/a>: in \u201ceradicating the power of the monarchy and the Roman Catholic Church\u201d during the French Revolution. Later, a 1905 French law made faith a strictly private matter and secularism the rule for the public sphere. There is nothing wrong with this arrangement. However, over the years the French have generally lost common sense relative to the subject and failed to be consistent in their approach to religion. On the one hand,<em> laicite<\/em> has caused some French men and women to see religion as a belief system that need not be taken seriously. Criticism of religion is seen as a \u201cdear right.\u201d On the other hand, recent history has led French governments to be very sensitive to even the slightest suggestion of anti-Semitism (which is illegal in France). Except in this case, the stipulation that one should not be critical of someone simply because he is observant is often forgotten.<\/p>\n\n\n\n<p>Against this backdrop, French Muslims, the most religious of French residents, have been held at arm\u2019s length. Those who retain their traditional dress and ways stand out as outsiders and assimilation has not been made easy even for those Muslims who desire it. <\/p>\n\n\n\n<p>The French will also tell you that the art of caricature \u201cis <a href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/France-Muhammad-cartoons.html\">an old tradition<\/a> that is part of our democracy.\u201d French Muslims make the argument that \u201cthere should be limits to offensive satire [in the form of demeaning caricature] when it comes to religious beliefs.\u201d They say that this is so because such satire \u201cfuels extremism.\u201d For millions of French Muslims, this suggests that \u201ccartoons putting a prophet who is fundamental to millions of believers in suggestive and degrading postures\u201d should not fall within the right to be satirical.<\/p>\n\n\n\n<p>One can, of course, argue the issue of censorship. Free speech\/expression rights are explicitly meant to protect speech we may not approve of. On the other hand, all societies impose some limits on speech\u2014you can\u2019t cry fire in a crowded theater. Who decides when, or if, there should be a legitimate restriction to free speech\/expression? How about when there is a present atmosphere that leads to multiple murder and the breakdown of otherwise friendly foreign relations? Under such circumstances, can such competing issues be finessed by the application of common sense? The flamboyant display of such \u201cart\u201d as practiced by <em>Charlie Hebdo<\/em>, much less its presentation as a cornerstone of French culture, might be such a case.*<\/p>\n\n\n\n<p>Part IV\u2014Conclusion<\/p>\n\n\n\n<p>How many cultures make rudeness a symbol of cultural excellence? It doesn\u2019t seem to be a common practice. Yet, the French have done so in this case. It has gotten them nothing but trouble at home and abroad. <\/p>\n\n\n\n<p>The problem with the present French position is that it gives wide latitude to people who care little or nothing for cultural awareness. Stephane Charbonnier, the murdered editor of <em>Charlie Hebdo<\/em>, seemed uninterested in the real cultural consequences of his personal practice of freedom. In truth, he was an extremist who persisted on insulting a religion of 1.8 billion adherents, the vast majority of whom are peaceful folks. As he knew no bounds to his freedom to be brutally insulting, so his behavior activated a small number of Muslim extremists willing to be even more brutal than Charbonnier. This led to his violent death. In death he has become a French cultural icon\u2014in total disregard of the extremist nature of his behavior and the counter-extremism it triggered.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>There has been a lot of feedback on this post, most of it taking me to task for undermining freedom of speech. One lawyer friend, who I have much respect for put it this way: “The freedom to criticize or mock any person or entity exercising absolute power such as a god, monarch, dictator or other unimpeachable person in whole or partial control is a necessary non-violent recourse against tyranny. e.g. The fable of the child observing that the emperor does not have any clothes. To be a right, as opposed to a privilege, freedom of expression must extend to those with whom we disagree and to those who speak rudely, irresponsibly, provocatively and without respect.
